The new sentencing guidelines for breaching health and safety regulations took effect on 1st February 2016.
Interestingly even under the old system fines in 4 cases between 21st and 26th January totalled £4.8m i.e. averaging over £1m per case.
Under these new guidelines UK companies operating with a turnover of more than £50m face unlimited fines starting from £7.5m for corporate manslaughter whereas smaller companies (turnover of up to £2m) still face a minimum fine of £450,000.
It’s clear that fine levels and prison sentences are set to increase dramatically.
